Our online shop www.tennis-balance.com ("Website") is available to you as a platform where you can purchase our own products and online books under the brand "Tennis Balance." The following GTCs apply to all orders placed by the customer at "Tennis Balance" or official distributors representing "Tennis Balance" products. By using www.tennis-balance.com and placing an order, the customer agrees to the GTCs of "Tennis Balance" and confirms having taken note of them.

An order is only possible for legal inquiries and orders by persons of legal age with a delivery address in Germany. The customer's personal data and information provided will be processed in accordance with "Tennis Balance's" privacy policy. By placing an order through this website, the customer agrees to the processing of information and assures that the provided information is true and accurate.

1.Orders and Use of the Website www.tennis-balance.com

The customer/contractor agrees to use www.tennis-balance.com exclusively for lawful inquiries and orders, refraining from submitting/facilitating any fraudulent and/or false orders/actions. In the event of any offense or illegal activity by the customer/contractor, "Tennis Balance" reserves the right to cancel the order and notify the relevant authorities of the incident. The customer/contractor agrees to provide their accurate and complete email address, postal address, personal or business data, and contact information, releasing this information for internal use by "Tennis Balance."

2.Contract Language

The purchase contract is concluded in the German language. The terms and conditions (AGBs) are not sent to the customer/buyer upon contract conclusion but must be viewed on the website www.tennis-balance.com.

3.Products

The items offered on the website www.tennis-balance.com include a selection of products from the field of tennis, as well as informational products offered in PDF format, video format, or photo/image format. The products presented on the website www.tennis-balance.com constitute a non-binding invitation for the customer/buyer to submit an offer. Each product is accompanied by the following information (if applicable):

  • Description of the item
  • Size & color (if applicable)
  • Price (in the corresponding currency)

3.1. Dampeners and Collector's Cards

3.1.1. Copyrights

All tennis dampeners offered by Tennis Balance and the accompanying collector's cards were invented and conceived by Ekaterina Yasinski and Maksim Yasinski. The copyright ownership of Tennis Balance's dampeners and collector's cards remains with Ekaterina Yasinski and Maksim Yasinski. Copies of any kind are unlawful and will be prosecuted.

3.1.2. Legends and Abilities

All abilities listed on the accompanying collector's cards are entirely fictional and serve purely for animation. Coincidences are just that—coincidences. Tennis Balance does not guarantee the acquisition of the abilities intended to be bestowed upon the user when using the dampeners. We provide no guarantees but merely offer the user the opportunity to believe in themselves even more.

3.2. Postcards

The designs of the postcards offered for sale by Tennis Balance were created by commercially utilized artificial intelligence. Any similarities to real persons and places are coincidental.

4.Product Availability

The products offered on the website www.tennis-balance.com are generally available for delivery. However, in exceptional cases, it may happen that the goods are not available for various reasons. In such a case, the customer/buyer will be promptly informed. A contract for the unavailable goods does not come into effect. Delivery is subject to stock availability.

5.Presentation

"Tennis Balance" strives to present and describe the items as truthfully as possible. However, in rare cases, there may be visual deviations. These variations can be attributed to the quality of the screen, computer, and online representation. Therefore, "Tennis Balance" does not guarantee that the colors and descriptions correspond 100% to the actual condition.

6. Prices

INFORMATION FOR GERMANY : The prices of the products on the website www.tennis-balance.com are final prices. Additional delivery and shipping costs may apply, as indicated in the provided information. Regularly, shipping costs for deliveries within Germany amount to 4.50 euros. Shipping costs are waived for deliveries over 59.00 euros. For items in the categories of "Books (PDF format) and Learning Videos (Video, Image, Photo format)," no additional shipping costs apply. INTERNATIONAL SHIPPING: Costs 18 Euro, free shipping from 80 Euro. 

7.Discounts, Special Offers, Vouchers, Advertising Measures

Discounts, special offers, vouchers, and advertising measures are valid until the specified date and while supplies last.

7.1. Vouchers (Gift Vouchers)

It is possible to purchase a gift voucher on the website www.tennis-balance.com. These are available while supplies last. The voucher can be used for all items offered on the Tennis Balance website. The amount is then offset against the purchase amount. If the balance of the gift voucher is not sufficient for the purchase, the price difference must be paid. Any remaining amounts, in turn, will be retained for future purchases. A refund of the voucher amount is not possible. Also, there is no option to return a gift voucher. All gift vouchers are valid for a limited time, specifically for three years from the date of purchase unless otherwise stated. It is not possible to use a gift voucher to purchase another gift voucher. If an order, which was purchased with a gift voucher, is canceled, the amount will be credited back as a gift voucher.

7.2. Contests

Tennis Balance conducts monthly contests. The organizer of the contests listed on the website www.tennis-balance.com is Tennis Balance, located at Jacob-Kees-Straße 14, 04416 Markkleeberg.

7.2.1. Participation

Eligible to participate are individuals of legal age (hereinafter referred to as "Customer/Buyer") who have made a purchase on the website www.tennis-balance.com during the current month. The Customer/Buyer automatically participates in the ongoing monthly contest once they enter into a purchase agreement with Tennis Balance. The purchase amount is irrelevant to participation. Participation in the contest is only possible if the items were acquired on the website www.tennis-balance.com. If items from Tennis Balance were purchased through a third party, this does not qualify for participation in the monthly contest.

7.2.2. Data Collection and Privacy

The Customer/Buyer is responsible for the accuracy of the information required for the contest. Otherwise, exclusion from the contest may occur. Personal data for the contest is extracted from the customer's personal information provided during the purchase. Consequently, the Customer/Buyer agrees to Tennis Balance's general privacy policy, which also applies to Tennis Balance's monthly contest. If participation in the contest is undesired, this should be indicated separately via email or as a comment during the order. By participating in the contest, the Customer/Buyer agrees that, if applicable, their data may be shared with partners and the relevant shipping company solely for the purpose of facilitating the delivery of the prize. The publication of the winning photo is only possible with the prior consent of the Customer/Buyer.

7.2.3. Exclusion from the Monthly Contest

Employees of Tennis Balance and, if applicable, cooperation partners involved in the contest are excluded from participating in Tennis Balance's monthly contest. This also applies to underage individuals. Customers/Buyers who have returned all purchased items in the respective month or have revoked the purchase agreement are not eligible to participate in the monthly contest. Only those who have entered into a successful purchase agreement and have not initiated a return with a full refund are eligible to participate in Tennis Balance's monthly contest.

7.2.4. Conduct of the Contest

Tennis Balance conducts monthly contests. There may be exceptions, meaning months in which no contest is held. Participants in the monthly contest are customers/buyers who have purchased one or more items on the website www.tennis-balance.com in the respective month and have not initiated a return for all purchased items. Revoking the purchase agreement also means exclusion from participating in the contest. By entering into the purchase agreement, the customer/buyer expressly agrees to participate in Tennis Balance's contest. Tennis Balance raffles tangible prizes or services during the monthly contest, which are financed by Tennis Balance or cooperation partners and made available for the contest. Cash payment of the prize value is excluded. Assignment and waiver of the prize are possible, whereby the customer/buyer notified by the organizer of the successful prize must send a notification of assignment to Tennis Balance by email. This can be done informally. The monthly contest is conducted as a lottery. A winner is determined by lottery from all customers/buyers (except those who have officially waived participation in the contest). Only one winner can be chosen monthly. Customers/buyers who have entered into a purchase agreement with Tennis Balance from the 1st of the respective month until the last day of the respective calendar month participate in the monthly contest or drawing. The last day of a calendar month can fall on the 28th, 29th, 30th, or 31st. The exact date is indicated in the respective calendar month. Participation in the contest in the following month is no longer possible with the purchase agreement from the previous month. The drawing takes place on the 5th of the following month.

7.2.5. Premature Termination of the Contest

Tennis Balance reserves the right to change the terms of participation and to terminate the contest prematurely at any time. This may happen without prior notice and does not require an explanation. Consequently, any claim to participate in the monthly contest is extinguished, and no compensation is demanded. If the termination of the contest is prompted by the behavior of a customer/buyer, Tennis Balance is entitled to demand any resulting damages from said customer/buyer.

7.2.6. Notification of Winnings

If a customer/buyer is drawn through a lottery, they will be notified by Tennis Balance on the 5th of the respective following month via email notification.

7.2.7. Liability

Tennis Balance is not liable for any damages related to the monthly contest of Tennis Balance. Tennis Balance has no influence on injuries to the body and health resulting from the use of the prize. Customers/buyers are obliged to use the prize properly and according to regulations and instructions. Tennis Balance is not liable for defects in quality or legality of the prizes. Nevertheless, Tennis Balance endeavors to check the functionality and completeness of the prizes before shipment. There is no liability on the part of Tennis Balance for the loss or damage of the prize by the shipping company.

7.2.8. Final Provisions

Legal recourse is excluded. Should individual provisions of the listed terms be or become invalid, the remaining terms and conditions remain unaffected.

8. Shopping Cart

The customer/buyer can select products from the assortment of the website www.tennis-balance.com and add them to a virtual shopping cart by clicking the "Add to Cart" button. If items need to be removed from the cart, the customer can do so in the cart by clicking on the "trash can icon" next to the selected item. In the shopping cart, the buyer can place a binding order by clicking the "Proceed to Checkout" button. This action concludes a purchase contract, and all items currently in the shopping cart at that time are acquired. By placing a payment order, the customer/buyer confirms the contract terms and accepts the general terms and conditions.

Payment and Payment Methods Once a purchase contract is established, the buyer/customer is required to make the specified payment. This includes the item price(s) and, if applicable, shipping costs. The purchased items can be paid for using the following

PayPal, bank transfer, credit card payment (Visa/Mastercard), and advance payment. If an online payment method is chosen (PayPal, credit card payment), the shipment will occur once the payment is received. The delivery period also begins only from that point. Until the complete payment of the goods and, if applicable, shipping costs, the items remain the property of Tennis Balance.

10. Order Confirmation

After the successful order by the customer/buyer on the website www.tennis-balance.com, they will receive an automatic order confirmation via email. This confirmation includes a list of the purchased items, along with price details and the total amount. In exceptional cases, email notifications may be filtered into the SPAM folder, and it is the responsibility of the customer/buyer to check for this.

11. Right of Withdrawal

The customer/buyer has the right to withdraw from the contract without giving any reasons within 14 days. The withdrawal period is 14 days from the day the customer/buyer or a third party known to the customer/buyer, other than the carrier, takes possession of the goods. Tennis Balance will refund the payment within 14 days after the successful and complete return of the goods ordered by the customer/buyer. The return of the goods must be in an intact and original condition. The goods must not exhibit any defects, damages, or alterations attributable to the customer/buyer. Otherwise, Tennis Balance may refuse the withdrawal of the contract. Any loss in value of the goods caused by the customer/buyer is to be borne by the customer/buyer. Tennis Balance covers the cost of the return shipment. To exercise the right of withdrawal, the customer/buyer is obligated to inform the seller (Tennis Balance) of the withdrawal through a clear statement (postal mail or email). The following sample form can be used for this purpose:

11.1. Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to purchase contracts for goods that have been custom-made for the customer/buyer or are clearly tailored to the individual needs of the customer/buyer. Additionally, any informational items are excluded from the right of withdrawal. This includes: books, online books (PDF format), online learning materials (video, photo, image format), and magazines.

12. Shipping and Delivery Time

 Germany: The delivery time is 4-8 business days. Tennis Balance ships from Monday to Saturday. The delivery period starts on the day of the shipping confirmation. If an item/product is no longer available, the customer/buyer will be promptly notified by email. The shipping costs are €4.50 for orders up to and including €58.99. For orders totaling €59.00 or more, Tennis Balance covers the delivery costs for the buyer/customer. Therefore, orders with a total value of €59.00 or more qualify for free shipping. For items in the "Informational Items" category, including online books (PDF format), online learning materials (video, photo, image format), no shipping costs are charged. Nevertheless, there is the option to apply the sum of items from the "Informational Items" category to the total amount of physical goods and take advantage of the free shipping option for orders exceeding €59.00 in total value. Hence, the total sum of purchased items determines eligibility. If this total surpasses €59.00, no shipping costs are incurred. Additionally, there are no freight, delivery, or transport costs.

INTERNATIONAL: Shipping cost is 18 Euro DHL. No shipping cost from 80 Euro in total value. 

13. Warranty

There is a claim for warranty for defects in the purchased items according to legal regulations. Warranty claims must be submitted with the order number, the name, and address of the customer, as well as a description of the defects/reasons. The existing defects must not have been caused by the customer/buyer. In the event of a warranty claim, the seller must be notified.

14.Returns, Refunds, and Exchanges

Germany: If the customer/buyer returns one or more items, they can do so within 14 working days. The return period begins upon receipt of the goods. In such a case, the product must be returned to Tennis Balance in its original condition, meaning sealed and with all labels attached. All items will be inspected by Tennis Balance upon return. Tennis Balance covers the return shipping costs. To request a return label, the customer/buyer must contact Tennis Balance and provide the order number. The refund will be processed within 14 working days after successful receipt of the goods using the same payment method as the original purchase. Only items purchased directly on the website www.tennis-balance.com can be returned. Items from Tennis Balance purchased through third-party vendors must be returned to those vendors. Excluded from exchange/return and exchange are items from the informational range (i.e., books, online books, photo, video, learning materials). After a period of 14 working days, Tennis Balance will no longer accept returns. If the customer/buyer attempts to return items to Tennis Balance after the 14-day period, Tennis Balance reserves the right to resend the item to the customer/buyer or refuse to accept the goods. In such a case, no refund/exchange will be issued.

14.1. Returns, Refunds, and Exchanges in Case of Fraudulent Activities

If Tennis Balance suspects fraudulent activities or observes unusual and suspicious behavior from a customer/buyer, the provision of returns/refunds and exchanges may be denied. Such activities may include actions such as claims related to non-received or missing items, returns of excessively large quantities, and returned items not matching the received ones. In such cases, no refund will be granted.

 

Applicable Law The laws of the Federal Republic of Germany apply.
